Pay gap between men and women is wider in Pennsylvania

Nationally, women earn about 80 cents for each dollar men receive. But in Pennsylvania, that figure is closer to 78 cents. According to the U.S. Bureau of Labor Statistics, Pennsylvania women earned a median weekly salary of $642 in 2008. The median salary for Keystone State men was $815.

Employee out on military leave: Must we pay him?

Q. We have an employee who will soon go on temporary military duty and be gone for several weeks. Do we have to pay him at all during his absence, or does he receive military pay?

Take advantage of tax breaks offered in new HIRE Act

With the unemployment rate still holding stubbornly near 10%, Congress this month approved a new $18 billion bill that offers tax breaks to employers who add certain new employees to the payroll. President Obama signed it on March 18.

Legislature considers new rules for armored car drivers’ breaks

State Sen. Mark Wyland, a Republican who represents San Diego County, recently introduced a bill that would exempt armored car companies from having to comply with California’s laws requiring rest and meal breaks for some employees.

That’s a lot of bread! Bimbo to settle for $3.75 million

Current and former drivers of Bimbo Bakeries USA who sued the company for allegedly breaking California’s meal and rest break laws are now offering to settle for $3.75 million. In the original action, drivers also charged Bimbo Bakeries with violating the Fair Labor Standards Act by failing to pay them overtime.

Pay the minimum or more? Broad tip pools OK

The FLSA has complicated rules for employers that pay less than the minimum wage to staff who receive tips. If tips aren’t large enough, then the employer has to top off the wages so the employee makes at least minimum wage. But what happens if the employer pays the customarily tipped employee minimum wage or more right from the start? That’s the question the 9th Circuit Court of Appeals recently answered for the first time.

Workers ‘illegal’? You still have to pay them

Employees can always sue if they haven’t been paid for their work—even if they’re in the country illegally and not eligible to work in the United States. Employers can’t use their undocumented status as an excuse for not paying minimum wage and overtime under the FLSA.

After military leave, does employee get across-the-board raise instituted while he was gone?

Q. Last month we reinstated an employee who was on military leave for six months. It’s the same position, with the same pay he received before he went on military leave. Effective Jan. 1, 2010, all employees in his department received a 4% pay raise in recognition for their hard work in 2009. Does the law require us to pay him at this increased rate?
