Can we limit cash awards to just some employees?

Q. When we win contracts, we recognize employees with cash awards. But these awards may be given only to the select few employees who were involved. Is this legally OK?

Why should we keep our policy of not providing references for former employees?

Q. We have a few supervisors who think it’s OK to write reference letters only for “good” employees. But our policy says supervisors can’t issue reference letters for any current or former employee. I’m having a hard time finding a reason that justifies our policy. Any suggestions?

How should we calculate paid ‘on-call’ time?

Q. We have a maintenance employee who we will soon put “on call” for various shifts—occasionally at night—to fix equipment. How should we handle his on-call pay?

Can we offer comp time instead of overtime pay for nonexempt employees who work OT?

Q. Can we offer our nonexempt employees comp time instead of overtime pay during a pay period? If we can, do we have to offer it at one and a half times, just like overtime is paid? For example, if an employee works one hour of overtime, do we have to give him one and a half hours of comp time?

Returning from disability leave, can employee dictate the terms of his new job?

Q. One of our employees has been out on disability leave for almost 16 months. He says he wants to return to work, but only if we give him a supervisory position without a lot of strenuous activity. We have no such position available. We’ve offered him other positions, but he’s refused them all. Can we legally terminate him?

Are we allowed to require a certain amount of advance notice for resignations?

Q. A group of our employees met during their break to have group prayer. A supervisor complained to our president, who said we should tell employees they can’t pray on break time, nor can they pray during lunch unless they leave the building. Some employees are upset. Is this policy legal?

Q. We’re afraid one of our employees may have been subjected to discrimination here at work. However, she hasn’t filed a complaint. What should we do? Do we have an obligation to bring it up and investigate even if she declines?

How should we handle mandatory overtime when determining FMLA leave hours?

Q. Can an employer deduct or count overtime hours from an employee’s FMLA balance? Our employees work overtime only from October through December. During that time, they’re required to work 12-hour days, seven days a week. We have several employees on both continuous FMLA and intermittent leave, and we’d like to deduct the overtime hours they would have worked from their FMLA allotment. What do you think?
